This disclaimer covers byteflavour.dev and the git forge at git.byteflavour.dev. The essential difference: on byteflavour.dev the content is mine; on the forge, much of it is not.

Liability for my own content

The content on this site was created with care. However, I cannot guarantee its accuracy, completeness, or timeliness. As a service provider, I am responsible for my own content under general law, per § 7(1) TMG (German Telemedia Act). Under §§ 8–10 TMG, however, I am not obligated as a service provider to monitor transmitted or stored third-party information, or to investigate circumstances that indicate unlawful activity.

Obligations to remove or block the use of information under general law remain unaffected by this. Any liability in this regard is only possible from the point in time at which a concrete legal violation becomes known. If I become aware of any such violations, I will remove the content in question immediately.

User content on the forge

The forge at git.byteflavour.dev is a platform on which signed-in users publish content of their own: repositories, source code, commits, issues, pull requests, comments, and attachments. That content is third-party information within the meaning of § 10 TMG. It is stored on behalf of those users, does not originate from me, is not reviewed by me in advance, and I do not adopt it as my own.

There is no general monitoring obligation, under § 7(2) TMG and Art. 8 of Regulation (EU) 2022/2065 (the Digital Services Act). Once I become aware of unlawful content, I will act without delay to remove it or disable access to it.

To report content that infringes rights, write informally to the address on the Imprint page — with the exact URL and a brief explanation. This applies to copyright infringement as much as to other unlawful content.

Anyone publishing content on the forge is responsible for holding the necessary rights to it and for complying with applicable law. Use of the forge is subject to my ability to suspend or remove accounts and content in cases of abuse.

Availability and data loss

The forge and the other services named here are run privately, not for profit, and with no guaranteed availability. There is no uptime commitment, no response time, and no entitlement to the service continuing to exist. Backups are made (see the Privacy Policy), but they are no substitute for your own precautions.

Concretely: keep your own copies of your work. With git that is the normal case anyway — every clone is a complete repository. It is less true for issues, comments, and attachments, where this instance is the only copy.

Garden notes

The Garden holds working notes that are published while still growing, by design. Each note carries a growth stage: seedling is a starting point that has not been verified or structured yet, budding has been worked through once with sources, evergreen is settled. Notes are drafted together with an AI agent and revised by me over time. A seedling in particular may contain errors, gaps, or claims I have not yet checked myself. Notes on legal topics carry an additional notice at the top. Nothing in the Garden is legal, financial, medical, or other professional advice.

This site links to my own, self-hosted services (e.g. git.byteflavour.dev, social.byteflavour.dev) as well as to third-party services such as Matrix (matrix.to) and Bluesky (bsky.app) — for example via the contact icons in the footer — and occasionally to external sources within individual pieces of content, for instance in the Garden. I have no influence on the content of externally linked pages; responsibility for that content lies solely with their respective operators.

Links set by me were checked for possible legal violations at the time of linking. No unlawful content was apparent at that time. Continuous monitoring of linked pages' content is not reasonable without concrete evidence of a violation. If I become aware of any legal violations, I will remove such links immediately.

This does not apply to links inside user content on the forge: those are not checked by me in advance, and no such prior review takes place. The section on user content above governs them instead.

Content and works created by me on this site are subject to German copyright law. Reproduction, editing, distribution, or any form of use beyond what copyright law permits requires my written consent. Downloads and copies of this site are permitted only for private, non-commercial use.

This expressly does not extend to content on the forge. What you may do with a repository hosted there follows solely from that repository's own license — usually a LICENSE file inside it — and not from this paragraph. Where no such license is present, ordinary copyright law applies: nothing is permitted beyond what the law grants anyway. Rights in user content remain with their respective authors.

Some content, notably Garden notes, is drafted with an AI agent and then edited by me. Copyright in such material extends only as far as my own creative contribution; for parts generated without it, I claim no more than the law grants.

Where content on this site was not created by me, third-party copyright is respected and such content is marked accordingly — see the Colophon for sources and licenses of fonts, icons, and tools used. If you nonetheless become aware of a copyright infringement, please let me know; I will remove the content in question as soon as I am notified.
